TERMS OF SERVICE

1. AGREEMENT TO TERMS By accessing and placing an order with Marta Ozog Ceramics, you confirm that you are in agreement with and bound by the terms of service contained below. These terms apply to the entire website and any email or other type of communication between you and Marta Ozog Ceramics.

2. PRODUCTS All items sold by Marta Ozog Ceramics are individually handcrafted. Each piece is unique, and slight variations in size, shape, glaze color, texture, and finish are inherent to the handmade process. These natural variations are not considered defects but rather characteristics that make each piece one-of-a-kind.

We make every effort to display colors and images accurately, but we cannot guarantee that your device's display will accurately reflect the actual product colors.

3. PRICING AND PAYMENT All prices are listed in Euros (EUR) and include VAT where applicable. We reserve the right to change prices at any time without notice, but changes will not affect orders already placed.

Payment is processed at the time of order. We accept payment via Shopify Payments and PayPal.

4. ORDERS AND PROCESSING As each piece is handmade, please allow 3-5 business days for processing before shipping. During busy periods (such as holidays), processing times may be extended to 7-10 business days.

For custom shipping arrangements to EU destinations, additional processing time may be required while we coordinate delivery details with you.

We will notify you if there are any significant delays with your order.

We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing or product information, or suspected fraud.

5. SHIPPING We currently ship directly to Ireland and Northern Ireland with a flat rate shipping fee calculated at checkout.

EU Shipping: If you are located elsewhere in the European Union and would like to purchase our products, please contact us at martaozogceramics@gmail.com to arrange shipping. We're happy to provide a custom shipping quote for EU destinations.

Orders are carefully packaged to ensure safe delivery. Once your order leaves our studio, risk of loss or damage passes to the carrier. We are not responsible for delays caused by the shipping carrier or customs.

6. PRODUCT CARE Our ceramics are designed for everyday use and are dishwasher and microwave safe unless otherwise stated in the product description. Handle with care, as ceramics can chip or break if dropped or knocked against hard surfaces.

7. RETURNS AND REFUNDS We want you to love your purchase. If you are not satisfied, you may return unused items in their original condition within 14 days of receipt for a refund or exchange.

Please note:

  • Due to the handmade nature of our products, minor variations in size, color, and finish are not grounds for return
  • Custom, personalized, or made-to-order items are final sale and cannot be returned unless defective
  • Customers are responsible for return shipping costs unless the item arrives damaged or defective
  • Items must be returned in original, unused condition with all packaging

EU Consumer Rights: EU customers have a 14-day cooling-off period to return items (excluding custom orders) under EU Distance Selling Regulations.

To initiate a return, please contact us at martaozogceramics@gmail.com with your order number and reason for return.

8. DAMAGED OR DEFECTIVE ITEMS Please inspect your order immediately upon delivery. If items arrive damaged or defective, contact us within 48 hours at martaozogceramics@gmail.com with photos of the damage and packaging. We will arrange for a replacement or full refund, including return shipping costs.

We package all items with great care, but cannot be responsible for damage caused by courier mishandling after proper packaging has been verified.

9. LIMITATION OF LIABILITY Marta Ozog Ceramics shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use our products, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to these terms or your purchase shall not exceed the amount you paid for the product.

10. INTELLECTUAL PROPERTY All content on this website, including images, text, designs, and logos, is the property of Marta Ozog Ceramics and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or use any content without our express written permission.

11. PRIVACY Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

12. GOVERNING LAW These Terms of Service are governed by and construed in accordance with the laws of Ireland. Any disputes arising from these terms or your purchase shall be subject to the exclusive jurisdiction of the Irish courts.

13. CHANGES TO TERMS We reserve the right to update or modify these Terms of Service at any time without prior notice. Changes will be effective immediately upon posting to the website. Your continued use of the website following any changes constitutes acceptance of those changes.
